TUTT™ Canada | Data and Privacy Protection Policy

At TUTT™ Electronics Store / Takcan Inc., we respect the privacy and security of customer information. This Data and Privacy Protection Policy explains how we handle personal information and device-related data when customers submit products for warranty review, inspection, paid repair assessment, troubleshooting, replacement evaluation, return review, or other service-related support.

This policy applies to products sold under the TUTT™ and iLoop™ brand ecosystem, including portable monitors, laptop screen extenders, smart displays, digital calendars, digital photo frames, tablets, laptops, smart devices, and other electronics that may store, display, synchronize, or connect to personal information.

This policy is intended to align with the Personal Information Protection and Electronic Documents Act (PIPEDA), the Office of the Privacy Commissioner of Canada’s PIPEDA fair information principles, and other applicable Canadian federal, provincial, or territorial privacy requirements where applicable.

Important: Customers should remove, back up, unlink, or disable all personal, sensitive, business, financial, account, cloud, photo, calendar, network, memory card, and device data before submitting any product for service. TUTT™ does not provide data recovery, data backup, data migration, password recovery, account recovery, photo recovery, calendar recovery, or cloud recovery unless expressly agreed in writing.

1. Purpose of This Policy

This policy explains how TUTT™ may collect, use, disclose, protect, retain, and dispose of personal information in connection with customer service, warranty review, paid repair assessment, inspection, troubleshooting, return review, marketplace validation, fraud prevention, and related support activities.

This policy also explains the customer’s responsibility to remove data from devices before service and includes a customer acknowledgment and waiver section for service-related submissions.

2. Personal Information We May Collect

Depending on the type of request, TUTT™ may collect personal information that is reasonably necessary to process, verify, assess, or respond to a customer service request. This may include:

  • Customer name, email address, phone number, mailing address, and contact details
  • Order number, purchase date, purchase platform, invoice, receipt, or marketplace details
  • Product model, SKU, serial number, device identifiers, warranty labels, and product photos
  • Photos, videos, written descriptions, and troubleshooting evidence submitted by the customer
  • Connected device details such as laptop model, operating system, app version, firmware version, router details, cable setup, charger type, or accessory information where relevant
  • Shipping, return, inspection, service, or repair communication records
  • Information required to verify claim eligibility, prevent fraud, comply with marketplace policies, or meet legal obligations

TUTT™ does not request unnecessary personal information and does not intentionally collect highly sensitive information unless it is required to process the customer’s request or is voluntarily provided by the customer.

3. Information That May Remain on Devices

Certain devices may contain or connect to personal information. Examples include photos, videos, contacts, documents, emails, calendar entries, Wi-Fi credentials, cloud accounts, app accounts, business files, financial information, browsing data, login tokens, memory card content, or synchronized information.

TUTT™ does not intentionally access, review, copy, transfer, recover, store, or manage customer personal data on submitted devices unless reasonably necessary for authorized service assessment, required for troubleshooting with customer consent, required by law, or needed to protect the rights, safety, or property of the customer, TUTT™, or others.

Customer responsibility: Customers must back up and remove all personal, sensitive, confidential, business, account, cloud, calendar, photo, video, network, memory card, and device data before sending any product to TUTT™. Customers should not submit devices containing information they are not willing to risk losing, deleting, exposing, or making inaccessible during service.

4. Customer Responsibilities Before Submitting a Device

Before submitting any product for warranty review, paid repair assessment, inspection, replacement evaluation, return review, or service, the customer is responsible for:

  • Backing up all personal, business, financial, photo, video, calendar, document, memory card, and cloud data
  • Deleting or removing all personal, sensitive, confidential, or business information from the device
  • Removing SIM cards, SD cards, microSD cards, USB drives, external storage, or other removable media unless specifically requested by TUTT™
  • Logging out of email, app, social media, cloud, calendar, banking, business, school, and company accounts
  • Disabling passwords, screen locks, passcodes, activation locks, device locks, remote locks, and account locks where required for service
  • Disabling remote access, remote tracking, cloud synchronization, automatic upload, and device-location features where applicable
  • Removing saved Wi-Fi networks, app pairing, cloud accounts, photo sync settings, calendar sync settings, and smart display account connections where applicable
  • Confirming that the customer has legal authority to submit the device and authorize service

5. Smart Displays, Digital Calendars, and Digital Photo Frames

Smart displays, digital calendars, and digital photo frames may contain or connect to photos, videos, calendar entries, reminders, Wi-Fi settings, cloud services, mobile app accounts, device pairing information, memory cards, local storage, and third-party integrations.

Customers must remove, unlink, delete, or back up this information before submitting the product for service. TUTT™ is not responsible for lost photos, deleted media, corrupted files, missing calendar entries, cloud synchronization issues, app pairing issues, account lockouts, memory card contents, third-party service interruptions, or data left on the device by the customer, except to the extent caused by TUTT’s proven gross negligence, wilful misconduct, or as otherwise required by applicable law.

6. How We Use Personal Information

TUTT™ may use personal information only for reasonable service-related, business, legal, security, and compliance purposes, including:

  • Processing warranty, repair, paid repair, return, inspection, or service requests
  • Verifying purchase records, marketplace eligibility, order details, and product authenticity
  • Communicating with customers about service status, missing information, estimates, shipping, or claim outcomes
  • Conducting troubleshooting, technical assessment, inspection, repair, replacement, or service evaluation
  • Arranging return shipping, service logistics, and marketplace communication
  • Preventing fraud, abuse, product substitution, serial-number tampering, false claims, or misrepresentation
  • Maintaining internal service records, legal records, accounting records, and compliance documentation
  • Responding to legal, regulatory, marketplace, law enforcement, or dispute-related requirements where applicable

7. Consent

By submitting information, completing a form, emailing TUTT™, requesting support, sending a device, approving service, or signing a service acknowledgment, the customer consents to the collection, use, and disclosure of personal information for the purposes described in this policy.

Where required, TUTT™ may request additional consent before performing specific actions, such as accessing a device screen, testing an app feature, reviewing a submitted video, contacting a marketplace, or sharing information with a service provider.

A customer may withdraw consent where legally permitted; however, withdrawal of consent may limit or prevent TUTT™ from processing the service request, warranty review, paid repair assessment, inspection, return, or support case.

8. Limiting Collection

TUTT™ aims to collect only the information reasonably necessary for the identified service-related purpose. Customers should not send unnecessary sensitive information, passwords, private documents, financial records, health information, unrelated photos, or unrelated account details.

If unnecessary information is submitted, TUTT™ may delete, ignore, redact, or decline to process that information where practical and appropriate.

9. Third-Party Service Providers and Disclosure

TUTT™ may share limited personal information with third parties only where reasonably necessary for service, support, logistics, legal, or compliance purposes. This may include:

  • Shipping carriers and return logistics providers
  • Marketplace platforms such as Best Buy, Amazon, Walmart, or other purchase channels
  • Manufacturer, authorized service technicians, repair partners, or inspection providers
  • Payment processors, accounting providers, email service providers, hosting providers, and business software providers
  • Legal, regulatory, insurance, dispute-resolution, or law enforcement parties where required or permitted by law

TUTT™ does not sell customer personal information to advertisers. Personal information is shared only as reasonably necessary for the purposes described in this policy or as otherwise permitted or required by applicable law.

10. Security Safeguards

TUTT™ uses reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information. These safeguards may include controlled access, limited internal access, service records, password-protected systems, secure communication practices, physical storage controls, staff instructions, and secure disposal practices.

No method of transmission, storage, email communication, shipping, device handling, or electronic processing is completely secure. Customers should not submit devices containing personal information that they have not backed up, removed, or are not prepared to lose.

11. No Data Recovery, Backup, or Migration Service

Unless expressly agreed in writing, TUTT™ does not provide data recovery, data backup, data migration, password recovery, account recovery, cloud recovery, photo recovery, calendar recovery, or memory card recovery services.

Service activities may require resetting, replacing, testing, repairing, or reconfiguring a product. These activities may result in data loss, device reset, app reset, firmware update, deletion of settings, loss of stored media, or loss of access to locally stored content.

12. Devices Submitted with Passwords, Locks, or Active Accounts

If a device is submitted with passwords, locks, activation restrictions, account locks, remote-management restrictions, cloud locks, or other access limitations, TUTT™ may be unable to inspect, test, repair, reset, or service the device.

TUTT™ may pause or decline service until the customer removes the restriction, provides written instructions, or arranges return shipping. TUTT™ is not responsible for delays caused by passwords, locks, accounts, remote access, IT-admin restrictions, or customer failure to prepare the device before submission.

13. Business, School, Government, and Managed Devices

Devices owned or managed by employers, schools, government organizations, institutions, or third parties may contain confidential, regulated, or restricted information. Customers must confirm that they have authority to submit such devices for service and that submitting the device does not violate any employment, school, government, IT, confidentiality, or data-security policy.

TUTT™ may decline service where a device appears to be restricted, managed, locked, or submitted without proper authority.

14. Retention of Personal Information

TUTT™ retains personal information only as long as reasonably necessary for service processing, customer communication, warranty or repair records, fraud prevention, marketplace verification, shipping records, dispute resolution, accounting, legal compliance, and business recordkeeping.

TUTT™ aims to follow the principle of limiting use, disclosure, and retention. Personal information that no longer fulfills its intended purpose may be securely deleted, destroyed, anonymized, or archived in accordance with applicable legal and business requirements. For reference, customers may review the Office of the Privacy Commissioner of Canada’s guidance on PIPEDA limiting use, disclosure, and retention.

15. Security Incidents and Privacy Breaches

If TUTT™ becomes aware of a security incident involving personal information under its control, TUTT™ will assess the nature and sensitivity of the information, the probability of misuse, and the potential risk to affected individuals.

Where required by applicable law, including PIPEDA’s requirements for breaches that create a real risk of significant harm, TUTT™ may notify affected individuals, report to the Office of the Privacy Commissioner of Canada, notify relevant organizations, and maintain required breach records.

For reference, customers may review the Office of the Privacy Commissioner of Canada’s guidance on mandatory privacy breach reporting for businesses and the official PIPEDA breach notification provisions.

Customers should immediately notify TUTT™ if they believe they have submitted a device or communication containing sensitive personal information that may be at risk.

16. Access, Correction, and Privacy Questions

Customers may contact TUTT™ to request access to personal information held by TUTT™, request correction of inaccurate information, ask privacy questions, or submit a privacy complaint.

TUTT™ may need to verify the identity of the requester before responding. Access or correction may be limited where permitted or required by law, including where disclosure would reveal another person’s information, confidential business information, fraud-prevention information, or information subject to legal privilege or legal restrictions.

17. Limitation of Liability for Customer Data

Customers are responsible for backing up, removing, unlinking, deleting, or protecting all personal information before submitting any product for service. TUTT™ is not responsible for data loss, account access, cloud synchronization, deleted files, corrupted files, memory card contents, lost media, lost calendar entries, passwords, login credentials, business interruption, loss of profits, lost time, or third-party account issues, except to the extent caused by TUTT’s proven gross negligence, wilful misconduct, or as otherwise required by applicable law.

Nothing in this policy is intended to exclude rights or remedies that cannot legally be excluded under applicable Canadian federal, provincial, or territorial law.

18. Non-Compliance Protocol

TUTT™ may decline to proceed with service if a device is received without required acknowledgment, required documentation, customer authorization, access information where needed, or return-shipping arrangements.

  • TUTT™ may notify the customer and request the required acknowledgment, missing information, or return-shipping arrangement.
  • Due to privacy and security concerns, customers may be responsible for arranging and paying return shipping for devices that cannot be serviced.
  • If there is no response after reasonable notice, TUTT™ may treat the device as unclaimed in accordance with applicable law, marketplace requirements, and internal service procedures.

Unclaimed device notice: TUTT™ will not automatically destroy or recycle a customer device without reasonable notice and consideration of applicable legal requirements. If a device remains unclaimed, TUTT™ may provide final notice and may take appropriate action permitted by law, which may include storage, return at customer expense, secure disposal, recycling, or other lawful handling.

19. Policy Updates

TUTT™ may update this policy from time to time to reflect changes in law, service practices, products, marketplace requirements, security practices, or business operations. The version posted on TUTT.ca is the current version unless otherwise stated.

TUTT™ Data and Privacy Protection Waiver

This waiver applies when a customer submits a device or product to TUTT™ Electronics Store / Takcan Inc. for warranty review, paid repair assessment, inspection, repair, replacement evaluation, troubleshooting, return review, or any other service-related process.

Customer Acknowledgment and Agreement

By signing, submitting, emailing, or otherwise accepting this waiver, the customer confirms that they have read, understood, and agree to the TUTT™ Data and Privacy Protection Policy and the terms below.

1. Customer Responsibility for Data

  • I confirm that I am responsible for backing up all data before submitting the device.
  • I confirm that I am responsible for removing or deleting personal, sensitive, confidential, business, financial, photo, video, calendar, cloud, account, memory card, and device data before service.
  • I confirm that I am responsible for removing passwords, locks, access restrictions, activation locks, remote locks, account locks, and device-management restrictions where required for service.
  • I confirm that I am responsible for logging out of accounts and disabling remote access, cloud synchronization, device tracking, and automatic upload features where applicable.
  • I confirm that I have removed SIM cards, memory cards, external drives, or removable storage unless TUTT™ specifically requested that they be included.

2. Smart Display, Digital Calendar, and Photo Frame Data

If the product is a smart display, digital calendar, digital photo frame, or related display product, I confirm that I am responsible for removing or backing up photos, videos, calendar data, reminders, Wi-Fi settings, app accounts, cloud accounts, memory card content, device pairing information, and any third-party service data before submission.

3. No Data Recovery or Backup Service

I understand that TUTT™ does not provide data recovery, data backup, data migration, password recovery, account recovery, cloud recovery, photo recovery, calendar recovery, or memory card recovery unless expressly agreed in writing.

4. Limitation of Liability

I understand and agree that TUTT™ Electronics Store / Takcan Inc. is not responsible for data loss, account access, cloud synchronization issues, lost photos, lost calendar entries, deleted files, corrupted files, memory card contents, business interruption, loss of profits, lost time, or third-party account/service issues related to data remaining on the device before, during, or after service, except to the extent caused by TUTT’s proven gross negligence, wilful misconduct, or as otherwise required by applicable law.

5. Device Access, Passwords, and Locks

I understand that if my device is submitted with passwords, locks, account restrictions, remote-management restrictions, activation locks, or other access limitations, TUTT™ may be unable to inspect, test, repair, reset, or service the product. I understand that TUTT™ may pause or decline service until the restriction is removed or return arrangements are made.

6. Authority to Submit Device

I confirm that I own the device or have legal authority to submit the device for service. If the device belongs to an employer, school, government agency, institution, or third party, I confirm that I have permission to submit the device and authorize service.

7. Service Handling and Privacy

I understand that TUTT™ does not intentionally access, review, copy, transfer, recover, store, or manage personal data on my device unless reasonably necessary for authorized service assessment, required for troubleshooting with my consent, required by law, or needed to protect the rights, safety, or property of the customer, TUTT™, or others.

8. Waiver Confirmation

I acknowledge that I have been given the opportunity to ask questions and seek clarification before submitting my product for service. I understand that failure to prepare the device, remove data, remove locks, or provide required information may delay, limit, or prevent service.
